Privacy Policy

Maintaining the trust and confidence of clients is a high priority for WealthUnite Advisors LLC (“WealthUnite”). Investment advisers are required by law to inform their clients of their policies regarding privacy of client information. That is why we want you to understand how we protect your privacy when we collect and use information about you, and the steps that we take to safeguard that information.

This Privacy Policy describes how we collect and use personal information that may directly, or indirectly, identify you during and after your engagement with us and/or through our website.  This Privacy Policy describes the basis upon which and for what purposes we process your personal information, how we protect your information, as well as your privacy rights under the Gramm-Leach-Bliley Act (“GLBA”) and, were applicable, under certain states’ privacy laws.

• Information we receive from you on account applications, such as your address, date of birth, Social Security Number, occupation, spouse/partner, children, financial goals, assets, liabilities, income, and estate planning information;

• Information about your transactions with us or others (e.g., other financial professionals); and

• Information received from credit or service bureaus or other third parties, such as your credit history or employment status.

Categories of Information We Disclose: We may only disclose information that we collect in accordance with this Privacy Policy. WealthUnite does not sell customer lists and will not sell your name to telemarketers.

Categories of Parties to Whom We Disclose: We will not disclose information regarding you or your account with us, except under the following circumstances:

• To your authorized Registered Representative and his or her manager;

• To service providers that perform services for us or function on our behalf, including financial service providers, such as a clearing broker-dealer (i.e. Schwab, Interactive Brokers, RL360, Stocktrade/Embark, Utmost, STM Life, etc.), investment company, or insurance company;

• To consumer reporting agencies,

• To third parties who perform services or marketing on our behalf;

• To your attorney, trustee or anyone else who represents you in a fiduciary capacity;

• To our attorneys, accountants or auditors; and

• To government entities or other third parties in response to subpoenas or other legal process as required by law or to comply with regulatory inquiries.

How Your Personal Information is Collected: We collect most of this personal information directly from you—in person, by telephone, text or email and/or via our website or other third-party software providers. However, we may also collect information:

• From publicly accessible sources;

• Directly from a third -party (e.g., sanctions screening providers, credit reporting agencies, or customer due diligence providers);

• From a third-party with your consent (e.g., your bank, other financial professionals);

• Legitimate Interests: Processing is necessary to the legitimate interests of our firm and/or third-party.

Regulation S-AM: Under Regulation S-AM, a registered investment adviser is prohibited from using eligibility information that it receives from an affiliate to make a marketing solicitation unless: (1) the potential marketing use of that information has been clearly, conspicuously, and concisely disclosed to the consumer; (2) the consumer has been provided a reasonable opportunity and a simple method to opt out of receiving the marketing solicitations; and (3) the consumer has not opted out. WealthUnite does not receive information regarding marketing eligibility from affiliates to make solicitations.

How Long Your Personal Information Will Be Kept: We will keep your personal information while you have an account with us or while we are providing investment advisory services to you. Thereafter, we will keep your personal information for as long as is necessary:

• To respond to any questions, complaints or claims made by you or on your behalf;

• To show that we treated you fairly; or

• To keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Please note, different retention periods apply for different types of personal information.

Our Security Policy: We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We maintain physical, electronic, and procedural security measures to safeguard confidential client information.

Closed or Inactive Accounts: If you decide to close your account(s) or become an inactive customer, our Privacy Policy will continue to apply to you.

401(k) Rollover Disclosure

A client or prospective client leaving an employer typically has four options regarding an existing retirement plan (and may engage in a combination of these options): (i) leave the money in the former employer’s plan, if permitted, (ii) roll over the assets to the new employer’s plan, if one is available and rollovers are permitted, (iii) rollover to an Individual Retirement Account (“IRA”), or (iv) cash out the account value (which could, depending upon the client’s age, result in adverse tax consequences). If WealthUnite recommends that a client rollover their retirement plan assets into an account to be managed by WealthUnite, WealthUnite acknowledges that it is a “fiduciary” under ERISA. This recommendation creates a conflict of interest if WealthUnite will earn a new (or increase its current) advisory fee as a result of the rollover. No client is under any obligation to roll over retirement plan assets to an account managed by WealthUnite.

UK Pension Rollover Disclosure

A client or prospective client with legacy pensions in the UK typically has five options regarding an existing retirement plan (and may engage in a combination of these options): (i) leave the money in the current plan, if permitted, (ii) rollover the assets to the new employer’s plan, if one is available and rollovers are permitted, (iii) roll over to a self-invested personal pension (SIPP), or (iv) rollover the assets to a qualifying recognised overseas pension scheme (QROPS) (which could trigger a 25% tax on your transfer if you do live in the country where the QROPS is based), or (v) cash out the account value (which could, depending upon the client’s age, result in adverse tax consequences). If WealthUnite recommends that a client rollover their retirement plan assets into an account to be managed by WealthUnite, WealthUnite acknowledges that it is a “fiduciary” under ERISA. This recommendation creates a conflict of interest if WealthUnite will earn a new (or increase its current) advisory fee as a result of the rollover. No client is under any obligation to roll over retirement plan assets to an account managed by WealthUnite.
